Terms and Conditions

These Terms and Conditions ("Terms") govern your use of English Mountain Network at englishmountain.net (the "Site"), which is run by volunteer property owners on English Mountain ("we", "us"). By creating an account or using the Site, you agree to these Terms. If you do not agree, please do not use the Site.

1. Information only, not legal advice

Everything on the Site, including news, documents, guides, maps, property records, meeting notes, contact lists and anything posted by members, is provided for general informational purposes only. It is not legal advice, and it is not financial, tax, surveying, real estate or other professional advice.

• We are not attorneys, and no attorney-client relationship is created by your use of the Site or by any communication with us or with other members.
• You must consult a licensed attorney about your own situation before relying on or acting on any information obtained from the Site.
• Laws, covenants, rules and records change. Information on the Site may be incomplete, out of date or wrong, and opinions expressed by members are their own.

2. No affiliation with the Property Owners Association

English Mountain Network is an independent site. It is not affiliated with, endorsed by, or acting on behalf of the English Mountain Property Owners Association, Inc. ("EMPOA"), its board, or its management. Nothing on the Site is an official statement of EMPOA.

Any documents on the Site that originated with EMPOA, such as covenants, bylaws, amendments, notices or correspondence, are documents that EMPOA has made freely available to the public, including on its own website. We share copies for convenience only; the versions held or published by EMPOA, or recorded with the Sevier County Register of Deeds, are the authoritative ones.

3. Where our information comes from

• Maps and property records. Parcel maps, ownership and assessment information come from Sevier County and the State of Tennessee and are freely available public records. We do not create or certify this data. The official county and state records control if they differ from what the Site shows, and the Site's maps are not a survey.
• Documents and other material. The Site contains only information that is a matter of public record or freely available to the public, or that has been posted with the consent of its original owner or author.
• Corrections. If you believe something on the Site is inaccurate, is not public, or was posted without permission, let us know (see "Contact" below) and we will review it promptly and correct or remove it where appropriate.

4. Accounts and membership

• You must be at least 18 years old to create an account.
• You agree to give accurate, current information, including your name, mailing address and the English Mountain section and lot(s) you own, and to keep it up to date.
• You are responsible for keeping your password confidential and for everything done with your account. Tell us right away if you believe your account has been used without your permission.
• We check membership details against public county records. Whether to verify an account, and which parts of the Site to open to it, is at our discretion.
• We may suspend or close any account, or remove any content, at any time and for any reason, including a breach of these Terms.

5. Acceptable use

You agree not to:

• Harass, threaten, defame or impersonate anyone, or post content that is unlawful, abusive, hateful or obscene.
• Use owner names, addresses or other information obtained from the Site to harass anyone, or for marketing, solicitation, debt collection, or any purpose prohibited by law.
• Post material you do not have the right to share, or anything that infringes someone else's copyright, privacy or other rights.
• Send spam, chain letters or unsolicited advertising through the Site's messaging.
• Copy, scrape or harvest data from the Site by automated means, or try to get into areas or accounts you are not authorized to use.
• Interfere with the Site's security or operation, or upload viruses or other harmful code.

6. What you post

You are responsible for the listings, messages, photos and other content you post. You keep ownership of it, but you give us permission to store, display and distribute it on the Site and in Site emails so the Site can work. We do not review everything that members post and are not responsible for it, but we may edit or remove any content at our discretion.

7. For Sale & Wanted

The For Sale & Wanted section is a free notice board for members. We are not a party to any sale or agreement between members, we do not inspect, guarantee or endorse any item, property or offer, and we are not responsible for any transaction. Deal with other members at your own risk and use good judgment.

8. Privacy

• We collect the information you give us when you join, and basic technical information needed to run and secure the Site (such as your IP address and sign-in times).
• We use it to run the Site, to verify property ownership against public records, and to send you account and Site emails. We do not sell or rent your personal information.
• Other members see only your first name and last initial on listings and messages. Your email address is not shown to them.
• Site administrators can see account details and messages sent through the Site when needed to operate the Site, investigate a complaint, or comply with the law.
• We may disclose information when required by law or to protect the safety and rights of members or others.

9. Copyright concerns

If you believe material on the Site infringes your copyright, contact us with a description of the work, where it appears on the Site, and how to reach you. We will remove material that we find infringing and may close the accounts of repeat infringers.

10. Links to other sites

The Site links to websites we do not control, such as Sevier County, EMPOA, Facebook and YouTube. We are not responsible for their content, accuracy or privacy practices.

11. Disclaimer of warranties

THE SITE AND ALL INFORMATION ON IT ARE PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING ANY WARRANTY OF ACCURACY, COMPLETENESS, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR NON-INFRINGEMENT. WE DO NOT PROMISE THAT THE SITE WILL BE AVAILABLE, UNINTERRUPTED, SECURE OR ERROR-FREE.

12. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, ENGLISH MOUNTAIN NETWORK, ITS ADMINISTRATORS, VOLUNTEERS AND CONTRIBUTORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROPERTY, MONEY, DATA OR OPPORTUNITY, ARISING FROM YOUR USE OF THE SITE OR YOUR RELIANCE ON ANY INFORMATION ON IT, EVEN IF WE HAVE BEEN TOLD SUCH DAMAGES ARE POSSIBLE. THE SITE IS FREE, AND OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO IT IS LIMITED TO ZERO DOLLARS ($0) OR THE LOWEST AMOUNT ALLOWED BY LAW.

13. Indemnification

You agree to defend, indemnify and hold harmless English Mountain Network and its administrators, volunteers and contributors from any claims, losses and expenses (including reasonable attorneys' fees) arising from your content, your use of the Site, or your breach of these Terms.

14. Ending your use

You may stop using the Site at any time and may ask us to close your account. Sections 1–3 and 6–16 continue to apply after your account is closed.

15. Changes to these Terms

We may update these Terms from time to time. We will change the "Last updated" date above and, for significant changes, may also tell members by email. Continuing to use the Site after a change means you accept the updated Terms.

16. Governing law and general terms

• These Terms are governed by the laws of the State of Tennessee, without regard to its conflict-of-laws rules. Any dispute will be brought only in the state or federal courts serving Sevier County, Tennessee.
• If any part of these Terms is found unenforceable, the rest remains in effect. Our not enforcing a provision is not a waiver of it.
• These Terms are the entire agreement between you and us about the Site.
